Legal Framework and Process of Residence Permit in Iran
As always, we have an act and a corresponding executive regulation. The “Act on entry and residence of the foreign nationals in Iran” and its eponymous regulation are the primary authorities to refer for this matter. Article 4 of the act divides the residence into two types, namely the permanent residence and the temporary residence. According to article 6, even the permanent permit must be renewed on a yearly basis. Article 5 of the executive regulation set terms for issuing permanent permit of residence. Among these terms are:
- Being a temporary resident for five years, whether on a consecutive basis or intermittent. (you must be at least 18 years old at the time of requesting this permit).
- The aforementioned requirement of five years could be reduced to two years if one be considered a confirmed “expert”, or a person who served the country, or a businessman who has invested in Iran, or finally proves by bank documents he has a personal income thereof.
- Being a spouse and father to an Iranian family.
Local offices of the passport police are the competent authorities to verify the requirements and the central office has to confirm it in order to issue a permanent permit.
